  • Review and interpret RFPs (Request for Proposals), RFQs (Request for Quotations), and other tender documents to ensure compliance with client-specified terms and conditions.
  • Review NDA's, Insurances, Bonds, Guarantees, Warranties, etc and any other documentation as may be required.
  • Examine contract terms to ensure alignment with company policies, identifying potential risks or areas of concern.
  • Prepare and manage project cost plans, budgets, and estimates.
  • Coordinate with architects, engineers, and planners to ensure commercial alignment across all stages of design and delivery.
  • Oversee tendering processes, including preparation of BOQs, pre-tender estimates, and tender evaluations.
  • Conduct value engineering and cost-benefit analysis.
  • Provide accurate cost advice to design and engineering teams throughout the project lifecycle.
  • Manage cost reporting, valuations, and final accounts.
  • Advise project teams on contractual rights, obligations, and risk mitigation strategies.
  • Manage change control procedures, including variations, extensions of time (EOT), and claims.
  • Thoroughly analyze variations / claims, including generating substantiation documentation. This includes discussion with the concerned team including review of contract documents, specifications, drawings, progress reports, and other relevant project documentation.
  • Prepare comprehensive and well-supported claim documentation defending our claim / additional fee and time.
  • Develop and prepare counterclaims, identifying and quantifying any damages or losses suffered due to breach of contract or negligence.
  • Represent in negotiations with Employer / Subs / Contractors to resolve claims amicably and efficiently.
  • Monitor contract performance and support dispute resolution if required. Explore alternative dispute resolution (ADR) methods such as mediation or arbitration where appropriate.
  • Work closely with legal counsel(if required), as needed, to obtain advice on complex claims issues and to represent the employer in legal proceedings.
  • Identify potential risks related to the project scope, costs, timelines, and contractual terms.
  • Ensure all contracts comply with legal, regulatory, and organizational requirements.
  • Ensure that any deviations from standard contract terms are properly documented and justified.
  • Collaborate with project teams to identify risks and ensure these are adequately addressed in the contract terms.
  • Develop strategies to mitigate risks during the contract drafting phase.
  • Act as a liaison between the project team, legal department, and other relevant stakeholders to ensure the accuracy of contract details in the proposal.
  • Identify scope creep and issue appropriate notices in accordance with contractual provisions in coordination with the project team.
  • Issue additional fee or claim letters in coordination with the project team and ensure appropriate follow-up to ensure the company is adequately compensated.

Documentation and Record Keeping:

  • Maintain accurate and organized records of all contract documents, including correspondence, negotiation notes, and finalized agreements.
  • Ensure contracts are stored in an accessible manner for easy retrieval and reference during project execution.
  • Meticulously maintain all records related to claims, including claim correspondence, analysis reports, legal opinions, and settlement agreements.
  • Stay abreast of current industry best practices, legal developments, and relevant case law related to construction claims.

Qualifications:

  • Bachelor's degree in engineering (Civil, Construction Management, or related field) or a Law degree with a focus on construction law.
  • Minimum of 15-18 years of experience in construction claims management, preferably within a consultancy or contracting environment.
  • Strong understanding of construction contracts (e.g., FIDIC, JCT, MOW etc.) and their legal interpretation.
  • Proven ability to analyze complex construction claims and develop effective strategies for resolution.
  • Excellent written and verbal communication skills, with the ability to articulate complex technical and legal issues clearly and concisely.
  • Strong negotiation and interpersonal skills.
  • Proficient in Microsoft Office Suite.
  • Experience with claims management software is a plus.
